This privacy policy (“Policy”) describes how Domiserver.com (“Company”, “we”, “our”, or “us”) collects, uses, shares, and stores personal information of users of its website and subdomains (the “Sites”). This Policy applies to the Sites, applications, products and services (collectively, “Services”) on or in which it is posted, linked, or referenced.

Please review our Privacy Policy and, if applicable, your contract with us. The purpose of this Privacy Policy is to provide Users with an understanding of what types of information we collect, how we treat it, and choices they may have related to this information. We reserve the right to change our Privacy Policy at any time. Any changes to this Privacy Policy, other than necessary to remedy typographical errors, will be announced on our home page.

By using the Services, you accept the terms of this Policy and our Terms of Use, and consent to our collection, use, disclosure, and retention of your information as described in this Policy. If you have not done so already, please also review our terms of use. The terms of use contain provisions that limit our liability to you and require you to resolve any dispute with us on an individual basis and not as part of any class or representative action. INFORMATION COLLECTION AND USE

    • Orders If Users purchase a product or service from us, we request personal information from them on our order form. Users must provide contact information (such as name, email and mailing address) and financial information (such as credit card number, CVV and expiration date). During the purchase process, Users may provide optional information to us. If that information is provided, it is covered by this Privacy Policy; however, providing it is voluntary. Credit card information is made secure by Encryption SSL Certificate.We use this information for billing purposes and to fill a User’s orders. If we have trouble processing an order, we will use this information to contact the User.

 

    • Customer Testimonials We post User’s testimonials/comments/reviews on our website which may contain personal information.  Users may contact us in writing at admin@domiserver.com to have their testimonial removed. We will remove it in 30 days.

 

    • Tell-A-Friend If Users choose to use our referral service to tell a friend about our site, we will ask the User for their friend’s name and email address. We will automatically send the User’s friend the User’s personal message via email. Domiserver stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Users or the User’s friend may request deletion of this information by contacting us in writing at admin@domiserver.com  This information will be removed in 30 days.

 

    • Customer Service We will communicate with Users in response to their inquiries, to provide the services they request, and to manage the Users’ account. We will communicate with Users by email or telephone, in accordance with their wishes.

 

    • Surveys or Contests From time-to-time we may provide Users the opportunity to participate in contests or surveys. If Users choose to participate, we may request certain personal information from them. Participation in these surveys or contests is completely voluntary and Users therefore have a choice whether or not to disclose this information. The requested information may include contact information, demographic information, and personal preferences. We may use a third party service provider to conduct these surveys or contests; that provider is prohibited from using our Users’ personal information for any other purpose. Users may request deletion of this information by contacting us in writing at admin@domiserver.com

 

  • Registration and Support The forms found on our website are used to gather contact information (such as name, email address, billing information, and phone number) of Users to process orders, respond to questions and requests. If Users need to change their personal account information, they may update it by making the change in their account.  We do not intentionally collect information from children under the age of 13.                   –Domiserver keeps records of User interaction and support provided (via chat, phone, and email) to track account history and better assist our Users. When Users contact Domiserver for support for their services, Users will be asked to match certain information that is in their Registration Information. This Registration Information will be used to identify Users personally. In the course of providing support to Users, Domiserver may annotate the Registration Information with information disclosed while providing support (Support Information).Support Information may identify Users individually. In addition to providing support to Users, Domiserver may disclose Support Information to third-party vendors in order to provide the support requested by Users. These third parties may disclose and use Support Information to improve their business processes and for marketing. Unless necessary to provide support to Users, Domiserver will not disclose Support Information containing information that identifies Users individually to these third parties. During a support request, Users may request that Domiserver not disclose Support Information to third parties. This request will prevent Domiserver from providing support to Users.

 

Information Automatically Collected. We may automatically record certain information about how you use our Sites (we refer to this information as “Log Data“). Log Data may include information such as a user’s Internet Protocol (IP) address, device and browser type, operating system, the pages or features of our Sites to which a user browsed and the time spent on those pages or features, the frequency with which the Sites are used by a user, search terms, the links on our Sites that a user clicked on or used, and other statistics. We use this information to administer the Service and we analyze (and may engage third parties to analyze) this information to improve and enhance the Service by expanding its features and functionality and tailoring it to our users’ needs and preferences.

We may use cookies, local storage or similar technologies to analyze trends, administer the Sites, track users’ movements around the Sites, and to gather demographic information about our user base as a whole.   • We rely on the following legal basis, under data protection law, to process your personal information:
  • Because the processing is necessary to perform a contract with you, or take steps prior to entering into a contract with you (e.g. where you have made a purchase with us, we use your personal information to process the payment and fulfil your order).
  • Because we have obtained your consent (e.g. where you contact us with a query, where you add optional information to your account profile, or if you consent to receive marketing from us).
  • Because it is in our legitimate interests as an information technology provider to maintain and promote our services. We are always seeking to understand more about our customers in order to offer the best products and customer experience, so we use information about you to tailor your view of our website, to make it more interesting and relevant in respect of the products and offers on view.

 

Marketing & Email Correspondence

Domiserver will use Users’ names and email addresses to send newsletters to them. These newsletters include information on promotions, services, and company information. We will contact you for marketing purposes where we have your consent or on the basis that it is necessary for the purposes of our legitimate interests. Out of respect for User privacy, we provide Users a way to unsubscribe in each promotional email.

We will send Users service-related announcements on occasion when it is necessary to do so; for example, if there is network maintenance, Users will receive an email. Users may opt out of these communications by clicking the unsubscribe link provided.

If Users do not want to receive our newsletter and promotional communications, they may opt out of receiving them by following the instructions included in each newsletter or communication or by emailing us at:  admin@domiserver.com

 

Third-Party Sharing

We will share Users’ personal information with third parties only in the ways that are described in this Privacy Policy. These third parties include credit card processors, technology vendors chosen by Users to be included in the services, and bandwidth providers. We do not sell User personal information to third parties except as described in this Privacy Policy. We may also disclose User personal information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • to parent, associated and subsidiary companies of Domiserver, as necessary to provide the services and assist with our business operations;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect User safety or the safety of others, investigate fraud, or respond to a government request; or
  • to any other third party with the User’s prior consent to do so.

Domiserver may aggregate information covered by this Privacy Policy and disclose it outside our business. This information will not identify Users individually.

Where we have responsibility for processing Users’ personal information and we transfer such personal information to a third party agent who is acting on our behalf, we will, under the Privacy Shield Principles, remain liable if our third party agent fails to process such personal information in a manner consistent with the Privacy Shield Principles unless we prove that we are not responsible for the event giving rise to the damage.

 

Linked/Advertiser Sites

From time-to-time, we may include links or banners for third-party sites, including sites that advertise. This privacy policy does not govern the information these sites collect when you visit them. These sites may know that you have visited them from our site.

 

Security

The security of Users’ personal information is important to us. We use commercially reasonable standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. When Users enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). Electronic communication (for example: email, online chat, or instant messaging) that Users may send Domiserver may not be secure unless Domiserver advises Users in advance that security measures will be in place prior to transmitting the information. Users should not send confidential information such as financial information, social security numbers or passwords to Domiserver through unsecured electronic communication.

Data Retention

We will retain User’s information for as long as their account is active or as needed to provide Users services. If Users wish to cancel their account or request that we no longer use their information to provide them services, contact us at admin@domiserver.com .   We will retain and use User information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Following termination of the Users’ agreement with us, Users will have no access to this information, and we may delete it for any reason, at any time.

Your Rights

If you are a user based in the European Economic Area (EEA), you may have certain rights in respect of your personal information, including the right to access, correct, and request the erasure of your personal information.

Upon written request, we provide Users with access to personal information they have provided to us. In most cases, we will need verify your identity by further means. Users can access this information by e-mailing us at admin@domiserver.com If Users are having trouble accessing the contact address above, our customer support team can assist them.

We will comply with any requests to exercise your rights in accordance with applicable law. Please be aware, however, that there are a number of limitations to these rights, and there may be circumstances where we are not able to comply with your request. Business Transitions

In the event Domiserver goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, Users’ personal information will likely be among the assets transferred.     We use Hotjar in some of our Services in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular device’s IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our Sites). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user.     Tracking Technologies Generally

    Information we will never collect. We will never ask you to share your private keys or wallet seed. Never trust anyone or any site that asks you to enter your private keys or wallet seed.

     

    USE OF PERSONAL INFORMATION

    To provide our service

    We will use your personal information in the following ways:

    • To enable you to access and use the Services
    • To provide and deliver products and services that you may request.
    • To process and complete transactions, and send you related information, including purchase confirmations and invoices

    INTERNATIONAL TRANSFER

    The Company has offices outside of the EU and has affiliates and service providers in the United States and in other countries. Your personal information may be transferred to or from the United States or other locations outside of your state, province, country or other governmental jurisdiction where privacy laws may not be as protective as those in your jurisdiction.

    We retain information we collect as long as it is necessary and relevant to fulfill the purposes outlined in this privacy policy. In addition, we retain personal information to comply with applicable law where required, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Use, and other actions permitted by law. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

    In some circumstances we may anonymize your personal information (so that it can no longer be associated with you) in which case we may use this information indefinitely without further notice to you.

    We employ industry standard security measures designed to protect the security of all information submitted through the Services. However, the security of information transmitted through the internet can never be guaranteed. We are not responsible for any interception or interruption of any communications through the internet or for changes to or losses of data. Users of the Services are responsible for maintaining the security of any password, biometrics, user ID or other form of authentication involved in obtaining access to password protected or secure areas of any of our digital services. In order to protect you and your data, we may suspend your use of any of the Services, without notice, pending an investigation, if any breach of security is suspected.

     

    INFORMATION CHOICES AND CHANGES

    Accessing, Updating, Correcting, and Deleting your Information

    You may access information that you have voluntarily provided through your account on the Services, and to review, correct, or delete it by sending a request to privacy@consensys.net. You can request to change contact choices, opt-out of our sharing with others, and update your personal information and preferences.

     

    ELIGIBILITY

    If you are under the age of majority in your jurisdiction of residence, you may use the Services only with the consent of or under the supervision of your parent or legal guardian. Consistent with the requirements of the Children’s Online Privacy Protection Act (COPPA), if we learn that we have received any information directly from a child under age 13 without first receiving his or her parent’s verified consent, we will use that information only to respond directly to that child (or his or her parent or legal guardian) to inform the child that he or she cannot use the Sites and subsequently we will delete that information.

     

    MARKETING COMMUNICATIONS AND SHARING

    You may instruct us not to use your contact information to contact you regarding services, promotions, surveys and special events that might appeal to your interests by contacting us using the information below. You can also opt out by following the instructions located at the bottom of any commercial emails messages you may receive.

    Please note that, regardless of your request, we may still use and share certain information as permitted by applicable law. For example, you may not opt out of certain operational emails, such as those reflecting our relationship or transactions with you, or important notifications regarding the Services we are providing to you, such as service-related announcements (e.g., if our Services are temporarily suspended for maintenance).

    Or, if you have downloaded our mobile application and enabled push notifications on your mobile device, we may send you alerts and notifications through push notifications, for example, to communicate status updates on our Services. However, you may choose to disable these notifications (except for the initial notification intended to verify your identity).

     

    THIRD PARTY LINKS AND WEBSITES

    This Privacy Notice does not address, and we are not responsible for, the privacy practices of any third parties, including those that operate websites to which our Sites link. The inclusion of a link on our Sites does not imply that we or our affiliates endorse the practices of the linked website. 

     

    CO-BRANDED WEBSITES

    In the event that our Sites link to other websites that include our branding, this Privacy Notice does not apply to those other websites. Visitors to those websites are advised to carefully read the notices on those individual websites.

     

    CHANGES TO THIS PRIVACY POLICY

    We may change this privacy policy at any time. We encourage you to periodically review this page for the latest information on our privacy practices. If we make any changes, we will change the Last Updated date above.

    Any modifications to this Privacy Policy will be effective upon our posting of the new terms and/or upon implementation of the changes to the Sites (or as otherwise indicated at the time of posting). Company does not sell (as such term is defined in the CCPA) the personal information we collect (and will not sell it without providing a right to opt out). Please refer to our Cookies Policy for more information regarding the types of third-party cookies, if any, that we use.

    Subject to certain limitations, the CCPA provides California consumers the right to request to know more details about the categories or specific pieces of personal information we collect (including how we use and disclose this information), to delete their personal information, to opt out of any “sales” that may be occurring, and to not be discriminated against for exercising these rights.

Consistent with California law, you may designate an authorized agent to make a request on your behalf.     Under the GDPR, you have certain rights regarding your personal information. You may ask us to take the following actions in relation to your personal information that we hold:

    • Opt-out. Stop sending you direct marketing communications which you have previously consented to receive. We may continue to send you Service-related and other non-marketing communications.

Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. If you would like to submit a complaint about our use of your personal information or response to your requests regarding your personal information, you may contact us at privacy@consensys.net or submit a complaint to the data protection regulator in your jurisdiction. 

    Cross-Border Data Transfer

    Please be aware that your personal data will be transferred to, processed, and stored in the United States. Data protection laws in the U.S. may be different from those in your country of residence. You consent to the transfer of your information, including personal information, to the U.S. as set forth in this Privacy Policy by visiting our Sites or using our service.

    Whenever we transfer your personal information out of the EEA to the U.S. or countries not deemed by the European Commission to provide an adequate level of personal information protection, the transfer will be based on a data transfer mechanism recognized by the European Commission as providing adequate protection for personal information.
